A refresher on the ADRP (alternative dispute resolution policy) because today it proved itself again! Here is what happened:
Our solution center team just took a call from a client who, 6 months ago, fired an employee with more than 15 years of service. The short story is that they spent a lot of time trying progressive corrective coaching, with no behavior change. So she was fired. She wasn't a bad person, she was just opposed to change and new responsibilities.

Even Dear Abby makes the fatal mistake of thinking she knows what she is talking about when it comes to employment law. Read her post below
Looks like good ‘ole Abby has just enough knowledge about terminating employees and at-will status to be dangerous. She made the all too common employer mistake, and cited at-will status of employer and employee as the reason the employee has no legs to stand on. She's not wrong; she's just clueless. |

Hiring smarter means filtering candidates. Filters include applications, assessments, tests, and interviews. Many companies are using background checks too, which begs the question, what’s the best type of background check? Studies indicate that as many as 70% of all resumes are embellished. And, as many as 60% contain outright falsehoods (lies), and convenient omissions. |

Health Care Reform Bill 2/25/2010 |

I've been getting so many calls from our CEDR Solution Center members on the health care reform bill, I decided to share my answers with everyone including our non-members.
These are the 2 questions. 1. Is this thing going to pass? 2. Will I have to provide health insurance to my employees if it does?
After considerable research my crystal ball says I expect the current democratic-driven administration to push a bill to the floor for a vote. So, even though the national coverage health care train appears to be slightly off the rails, this is a good jumping on point for all of us to check into what the legislation looks like in its current format. |

The following is such a recent and interesting example of "something is wrong here" in the workplace, that I just wanted to share it and I am sending it to everyone, member or not.
On August 6th of 2009, an Indiana Court ruled that a man weighing 340 pounds, whose back was injured on the job by a freezer door that hit him while working for a pizza restaurant, is subsequently entitled to lap band stomach surgery at the expense of the company in addition to back surgery for the on the job injury. |
